Terms of use

Version 1.0 — Friday 18 September 2026

1. About these terms

These terms of use set out the rules for using the InCheshire app and website (together, “the Service”). By accessing or using the Service, you agree to be bound by these terms. If you do not agree, please do not use the Service.

We may update these terms from time to time. When we do, the updated version will be made available in the App and on this page.

2. Who we are

The Service is provided by Cheshire West and Chester Council (“we”, “us”, “our”). Our address is Cheshire West and Chester Council, The Portal, Wellington Road, Ellesmere Port, CH65 0BA.

The Service is built and operated on our behalf by Vicinity Trading Limited, Commer House, Tadcaster Enterprise Park, Station Road, Tadcaster, West Yorkshire, LS24 9JF.

3. Using the Service

The Service is intended for people aged 13 and over. If you are under 18, you should use the Service with the permission of a parent or guardian.

You agree to use the Service lawfully and not to:

  • misuse the Service or interfere with its normal operation;
  • impersonate another person or misrepresent your identity;
  • submit content that is offensive, unlawful, defamatory or misleading;
  • attempt to access areas of the Service you are not authorised to use;
  • use the Service to send spam or unsolicited communications.

4. Your account

Some features require an account. When you register, you must provide accurate information and keep it up to date. You are responsible for keeping your password secure and for all activity that happens under your account.

If you think your account has been compromised, change your password and contact us as soon as possible.

5. Content you share

The Service may let you post reviews, photos, comments, check-ins or other content. You keep ownership of your content, but you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it so that we can operate and promote the Service.

You must only share content you have the right to share. We may remove content that breaches these terms or that we consider inappropriate.

6. Intellectual property

The InCheshire name, logo, software, designs, text, images and other materials belonging to us or our licensors are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from them without our permission.

7. Third-party links and listings

The Service includes listings, offers, events and links provided by local businesses, partners and other third parties. We do not endorse these third parties or guarantee the accuracy of their content. Your dealings with them are between you and them.

8. Availability and disclaimer

We aim to keep the Service available and up to date, but we do not guarantee uninterrupted or error-free access. Information about places, events, offers and rewards is provided for guidance and may change. Please confirm important details directly with the business or venue.

The Service is provided on an “as is” basis without warranties of any kind, except those that cannot be excluded by law.

9. Our liability

To the extent permitted by law, we will not be liable for any indirect, consequential or special loss arising from your use of the Service.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Suspension and termination

We may suspend or terminate your access to the Service at any time if you breach these terms, if we need to carry out maintenance, or for other operational or legal reasons. You may stop using the Service and delete your account at any time in the App’s settings.

11. Changes to these terms

We may change these terms from time to time. If we make material changes, we will notify you through the App or by email where possible. Continued use of the Service after the changes take effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales, and any dispute arising from them will be dealt with by the courts of England and Wales.
